1.   General

(a)    This policy applies to all personal information collected by Omni Packaging NZ Ltd (NZBN 9429053448378) (we, us or our) via the website located at www.omnigroup.co.nz (Website) and in the course of providing our products and services.
(b)    Your privacy is important to us. We are committed to protecting your personal information in accordance with the privacy principles (Privacy Principles) set out in the Privacy Act 2020  (Privacy Act).
(c)    This policy outlines how and when we collect, process, use, share, store, disclose, alter and destroy your personal information and applies to all personal information we collect through: 
          (i)        the Website; and
          (ii)       our products and services.

(d)    This policy should be read in conjunction with our Terms and Conditions. By accessing or using the Website or otherwise providing Personal Information to us, you consent to the collection and use of such information by us and our agents in accordance with this privacy policy.

2.   What personal information do we collect?

(a)    Personal Information means information about an identified individual or an individual who is reasonably identifiable, whether or not the information is true or recorded in material form.
(b)    If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this policy.
(c)    The types of Personal Information we collect from you will depend on how you use or access our Website, including:
         (i)         name, address phone number and email address;
         (ii)        information about the products or services you order or enquire about, including how the products or services are used; 
         (iii)       Website login credentials;
         (iv)       payment details (such as credit card number and bank account details), method of payment and any additional information required for user authentication processes; and
         (v)        any other information relating to you that you provide to us, including the information you provide by email or telephone.

3.   How we collect your Personal Information

We may collect Personal Information from you in several ways, including: 
(a)    when you visit the Website and submit information through the Website or related app;
(b)    when you contact us or complete any forms or documents for our products of services;
(c)    through your use, or orders of our products or services (and our records of these);
(d)    when you participate in our surveys, competitions, promotions, questionnaires or other promotional activities we may run from time to time; 
(e)    from third parties; and
(f)    from publicly available sources of information. 

Where we collect personal information from a third party, we will take reasonable steps to ensure you are aware of the collection, the purpose for which it is being collected, the intended recipients, our contact details, the legal basis upon which we are authorised or required to undertake the collection, and your rights to access and correct the personal information, to the extent required by the Information Privacy Principle 3A of the Privacy Act.

Where you provide us with personal information regarding any other individual, you confirm that such individual has authorised you to provide this personal information to us for the purposes set out in this Privacy Policy.

4.   Purpose of collection

(a)    We will not use or disclose your personal information except in accordance with this Privacy Policy and the Privacy Act.

(b)    In particular, we use your Personal Information to:
         (i)         provide you with our products or services, or the Website;
         (ii)        provide you with the best service experience possible on the Website and keep in touch with you about developments in our business; 
         (iii)       improve, develop and manage our products, services and the Website;
         (iv)       operate, maintain, test and upgrade our systems; 
         (v)        notify you of important changes to our Website; and
         (vi)       notify you of rewards, opportunities and promotions we think you might be interested in, including new product or service offerings.

(d)    By using our Website, you consent to the receipt of direct marketing material. We will only use your Personal Information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from use. We do not use sensitive Personal Information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature, such as an unsubscribe button link.
(e)    You can opt out of receiving these communications by:
        (i)         contacting our Privacy Officer. We will process opt-out requests within 5 business days and maintain records of your preferences.
        (ii)        using the unsubscribe function in the email or SMS.

5. Disclosure of Personal Information to other parties

(a) We will only use and disclose your Personal Information with third parties, in accordance with the Privacy Act, to: 

(i) Provide the products and services (including the Website) to you;

(ii) Disclose or use information as authorised by you;

(iii) Comply with applicable law, legal or regulatory process;

(iv) Facilitate a business transfer, merger or sale; and

(v) Protect the personal health and safety of our users or the public.

Your Personal Information will be made available internally (including with our affiliates and related companies, including Omni Packaging Pty Ltd (ACN 609 971 717) for the above purposes and we may also disclose your Personal Information to third parties, who have agreed to treat your Personal Information in a manner consistent with this Privacy Policy, for the same or similar purposes. We will not sell, rent or lease your Personal Information to third parties. By providing us with your Personal Information, you consent to us using and disclosing your Personal Information in the manner set out above.

(a)    We may also collect cookies which enable us to tell when you use the Website and also to help customise your Website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies. 
(b)    Most browsers are initially set up to accept cookies. However, you can reset your browser to refuse all cookies or warn you before accepting cookies. 
(c)    If you reject or disable our cookies or similar technologies, you may still use the Website but may only have limited functionality of the Website. 
(d)    We use different types of cookies including essential cookies for Website functionality, analytical cookies to improve user experience, and marketing cookies that may be set by third parties. Third-party cookies are subject to their respective privacy policies, which we encourage you to review.
(e)    Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, in cases like this we will take steps to make you aware of the information that was provided by a third party.

(a)    Our Website may contain hyperlinks to third party websites. We make no representations or warranties in relation to the privacy practices of any third party provider or service, and do not endorse any of these third parties, their products or services, or the content on these websites. We are in no way responsible for the privacy practices or content of these third party websites. 
(b)    These websites are not subject to our privacy standards, policies and procedures. Therefore, we recommend that you make your own enquires about their privacy practices. 

8.   Data Security, Retention and Breach Notification

(a)    We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure.

(b) The length of time we keep Personal Information depends on the nature of the information and whether we have an ongoing business need to retain it. When we no longer require your Personal Information for the purpose for which we obtained it, we will take reasonable steps to destroy and anonymise or de-identify it. Most of the Personal Information that is stored in our client files and records will be kept for a maximum of 7 years to fulfil our record keeping obligations.
(c) If we become aware that personal information we hold about you has been lost or subject to unauthorised access, misuse, interference, or disclosure, we will comply with any applicable notification obligations.

8. Access and Correction

(a)   We will endeavour to keep your personal information accurate, complete, and up to date. It is your responsibility to let us know if the personal information we hold about you needs to be corrected or updated.

(b) Subject to certain grounds for refusal set out in the Privacy Act, the Privacy Principles:
 (i)    permit you to obtain access to the Personal Information we hold about you; and
 (ii)    allow you to correct inaccurate Personal Information

(c)    If you would like to access Personal Information we hold about you and seek to correct any such information, you can do so by contacting our Privacy Officer.  We will respond to your request as soon as reasonably practicable.

8.   Changes to this policy

(a)    We may change this policy from time to time at our discretion. 
(b)    Any revised policy will be posted on our Website and will be effective from the time of posting. 
(c)    Your continued use of our products, services or the Website following the posting of any revised policy indicates your acceptance of the changes to this policy. 
(d)    You should regularly check and read this policy.

9.   Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us our Privacy Officer. All complaints will be considered by our Privacy Officer and we may seek further information from you to clarify your concerns. We will use reasonable endeavours to respond to your request as soon as reasonably practicable. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Privacy Commissioner at https://www.privacy.org.nz/about-us/contact/.

10.   Documentation and Response Timeline

We will acknowledge receipt of your complaint within 7 business days and provide you with a reference number. Our Privacy Officer will investigate your complaint and maintain detailed records of all communications and findings. We aim to resolve all privacy complaints within 28 business days. If additional time is required, we will notify you in writing. All complaint documentation will be retained for 12 months following resolution. 

11.   Overseas transfer Your Personal Information will not be disclosed to recipients outside New Zealand, except to the extent it is made available internally to our affiliates and related companies in Australia (including Omni Packaging Pty Ltd (ACN 609 971 717)), or unless you expressly request us to do so.

In circumstances where we need to disclose or transfer your Personal Information to third parties and service providers located outside of New Zealand, we will only disclose Personal Information overseas if:

• We believe on reasonable grounds that the overseas recipient is required to protect the information in a way that, overall, provides comparable safeguards to those we are bound by; or
• We believe on reasonable grounds that the overseas recipient will adequately protect the information, e.g. by using model contract clauses; or
• We believe on reasonable grounds that the overseas recipient is subject to the Privacy Act because they do business in New Zealand; or
• The individual concerned authorises the disclosure after being expressly informed that the overseas recipient may not be required to protect the information in a way that, overall, provides comparable safeguards to those we are bound by; or
• We otherwise have a legal basis to do so.

If you request us to transfer your Personal Information to an overseas recipient where the overseas recipient is not be required to comply with the Privacy Principles, we will not be liable for any mishandling of your information by such recipient.
